Artist Release Statement
Please read carefully:	Artist Release: The Artist seeks to submit the images identified here (initialed in the Image List) for the Common Ground 2008 competition, exhibition and limited edition reproduction. Common Ground reserves the right to select any artwork/images entered in Common Ground to be displayed on a digital page of the Web Site at www.CommonGround2008.com and use on publicity materials both printed and through electronic media. Common Ground has the right to change an image size if the image does not conform into the exhibit, printing or internet formats. I hereby grant to Common Ground, its affiliates and licensees the following irrevocable rights: To use and re-use, publish and re-publish the image, in whole or in part, individually or in conjunction with printed matter, or in composite form, and in any medium, consistent with the purposes of Common Ground, which is to promote digital art with the theme of environmental stewardship. I hereby waive any right to inspect or approve any copy that is used in connection with the image and release and discharge Common Ground and its Board from any and all claims arising out of use by the Common Ground, of the image for the purposes described above, including any claims for libel, invasion of privacy or breach of copyright. The Artist warrants and represents that he or she is the sole legal owner of all rights, title and interest in all Artwork and the Image of the Artwork, including all related intellectual property interests such as trademarks and the sole and exclusive copyright in all artwork, and has the full right and authority to enter this Agreement and grant the rights granted in this Agreement. The Artist also warrants and represents that the use of the image by Common Ground as stipulated above does not and will not infringe or violate the rights of any other party, including any copyright interests. The Artist shall indemnify, defend and hold the Common Ground, its officers and/or licensees harmless from any losses, claims, damages, awards, penalties or injuries incurred, including reasonable attorney's fees, which arise from any claim by any third party of an alleged infringement of copyright or any other property right arising out of the display of the image. The Artist understands that the display and use of the image by Common Ground is subject to the sole discretion of Common Ground. The Artist grants Common Ground a nonexclusive, royalty free, license to use the image as describe above. By submitting an Entry the Entrant hereby grants Common Ground its agents and assigns, a non-exclusive, worldwide license to publish and use the Entry if it is awarded acceptance into the Common Ground Collection. This use is not limited to the publication and promotion of the Common Ground Collection to which the entry was submitted. Common Ground agrees to give credit to the author/copyright owner of the work. Common Ground will negotiate in good faith with the artist with regard to any additional requests for the use of these images that are outside the scope of this License. Indemnity and Non-liability: Entrant agrees to indemnify Common Ground and to hold it harmless from any costs, expenses or damages, including court costs and reasonable attorney's fees, arising out of the breach or alleged breach of the above representations and warranties. Entrant agrees that Common Ground shall not be liable for any loss or damage arising from acts or omissions of Entrant, including but not limited to the payment of any money owed to interested third parties. Right to Withdraw Entries: Common Ground reserves the right, in its sole discretion, to reject any Entry. Common Ground further reserves the right, for any reason, not to publish the limited editions for which the Call for Entries was intended.
